The constitutional court has ruled to provisionally suspend the Andalusian regional government’s anti-eviction decree, which has been in force since April 12.
The decree allowed for the expropriation of properties belonging to banks and their attribution to families who found themselves in precarious circumstances and unable to pay off their mortgages. The daily reports 12 families had taken advantage of the measure.
The court, which will now have five months to issue a definitive ruling, moved to suspend the decree in response to a case filed by Spain’s central government, which believes that the regional regulation is both unconstitutional and contributory to legal uncertainty damaging to the country’s banking sector, a position shared by the European Commission.
